TERMS OF SERVICE AGREEMENT

DISCLAIMER AND GOVERNING ENTITY

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and EMOGIR.LS LLC, doing business as Zelfur.gg ("Company," "we," "us," or "our"), the operator of Greed ("Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. Any violation of applicable laws, regulations, or Discord's Terms of Service and Community Guidelines is strictly prohibited. Violations should be reported via written communication to [email protected]. The Company reserves the right to terminate service access and impose permanent restrictions across all Company services for any user receiving a refund, without prior notice or liability.

SERVER REPORTS & VIOLATIONS

The Company hereby disclaims any and all responsibility for processing or handling server reports. The Company lacks the capability to verify or authenticate the veracity of such reports and therefore cannot undertake any action predicated upon them.

In the event of encountering servers that violate Discord's Terms of Service or Community Guidelines, users are required to report such violations directly to Discord through their designated support channel at dis.gd/support.

  • The Company explicitly disclaims any obligation to investigate server-specific violations or disputes
  • The Company shall not remove the Service from servers based on third-party allegations
  • The Company bears no responsibility for mediating conflicts between server members or administrators
  • All violation reports must be directed to Discord's Trust & Safety team through official channels

DATA COLLECTION AND PROCESSING ACKNOWLEDGMENT

By accessing and utilizing the Service, you hereby acknowledge and consent to the following data collection and processing practices:

IP ADDRESS PROCESSING:

  • Collection and storage of IP addresses in cryptographically hashed format within Company systems
  • Processing and retention by Cloudflare Enterprise for a period not to exceed three hundred and sixty-five (365) days
  • Implementation of security measures and abuse prevention protocols

CLOUDFLARE ENTERPRISE DATA PROCESSING:

  • Collection and analysis of browser and device specifications
  • Processing of geographic location data pursuant to service delivery
  • Monitoring and analysis of traffic patterns and security events

PROHIBITED ACTIVITIES AND RESTRICTED USES

WEBSITE USAGE RESTRICTIONS:

  • Any attempts to exploit, compromise, or circumvent the Service's security measures
  • Unauthorized or malicious utilization of the Service's infrastructure
  • Automated data collection, scraping, or harvesting for unauthorized purposes
  • Unauthorized framing or reproduction of the Service's interface
  • Misappropriation or unauthorized reproduction of the Service's intellectual property

SERVICE USAGE RESTRICTIONS:

  • Any actions in contravention of Discord's Terms of Service
  • Unauthorized reproduction or emulation of the Service's functionality
  • Facilitation or assistance in the unauthorized reproduction of the Service
  • Engagement in activities designed to exploit or compromise the Service
  • Operation of servers previously terminated for Terms violations

SERVICE LIMITATIONS AND WARRANTY DISCLAIMER

The Company provides the Service strictly on an "as-is" and "as-available" basis. The Company hereby expressly disclaims any representations or warranties of any kind, whether express or implied, including but not limited to:

  • Continuous, uninterrupted, or error-free operation of the Service
  • Guaranteed levels of uptime or service availability
  • Prior notification of maintenance operations or service interruptions

The Company explicitly disclaims any obligation to provide compensation or refunds for any service interruptions, regardless of duration or cause. Users acknowledge and accept that temporary service disruptions may occur and waive any claims arising from such disruptions.

LIMITATION OF LIABILITY AND INDEMNIFICATION

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EMOGIR.LS LLC, DOING BUSINESS AS ZELFUR.GG, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, use, goodwill, or other intangible losses arising out of or in connection with the Service
  • Unauthorized access to, or alteration of, your Discord server or transmitted data
  • Actions or omissions of third parties in relation to the Service
  • Data loss, corruption, or compromise resulting from Service usage
  • Economic losses arising from Service functionality or unavailability
  • Damages resulting from Service interruptions or modifications
  • Any errors, omissions, or inaccuracies in the Service
  • Personal injury or property damage of any nature whatsoever

THE COMPANY'S AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, TO USE THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.

THESE LIMITATIONS SHALL APPLY REGARDLESS OF THE LEGAL THEORY OR FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, WARRANTY, OR ANY OTHER LEGAL OR EQUITABLE THEORY, AND WHETHER OR NOT THE COMPANY WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

DISPUTE RESOLUTION AND ARBITRATION

AGREEMENT TO ARBITRATE

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

CLASS ACTION WAIVER

All claims and disputes within the scope of this arbitration agreement must be arbitrated on an individual basis and not on a class basis. Any claim or dispute raised as a class, collective, consolidated, or representative action is strictly prohibited. By using our services, you expressly waive any right to participate in a class action lawsuit or class-wide arbitration.

ARBITRATION PROCEDURES

  • The arbitration will be conducted by a neutral arbitrator
  • The arbitration will be conducted online or in your local jurisdiction
  • Each party will bear their own costs of arbitration
  • The arbitrator's decision will be final and binding

EXCEPTIONS

Nothing in these Terms will be deemed to waive, preclude, or otherwise limit the right of either party to: (a) bring an individual action in small claims court; (b) pursue enforcement actions through applicable federal, state, or local agencies; or (c) seek injunctive relief in a court of law in aid of arbitration.

30-DAY RIGHT TO OPT OUT

You have the right to opt-out and not be bound by the arbitration and class action waiver provisions by sending written notice of your decision to opt-out to [email protected] within 30 days of first accepting these Terms.

TERMINATION

We reserve the right to terminate your access to our services immediately without prior notice or liability for any reason, including but not limited to:

  • Violations of these terms
  • Abuse of our services
  • Violation of Discord's Terms of Service
  • At our sole discretion

CHANGES TO TERMS

We can update these terms at any time without notice. Continuing to use our services after any changes will mean that you agree with these terms and violation of our terms of service could result in a permanent ban across all of our services.
